1 Acceptance of Terms

By accessing or using Toastlytics (“the Service”) at toastlytics.com, you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2 The Service

Toastlytics is an AI-powered trading journal platform that allows users to log trades, analyse performance, track emotional patterns, and receive AI-generated coaching insights.

The Service is currently in alpha. Features may change, be added, or be removed at any time. We will make reasonable efforts to notify users of significant changes via email.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3 Accounts

To use the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and not share it with others
• Notify us immediately at hello@toastlytics.com if you suspect unauthorised access
• Accept responsibility for all activity that occurs under your account
• Be at least 18 years of age (or the legal adult age in your jurisdiction)

You may create multiple trading accounts within a single Toastlytics account (e.g. for separate brokers or prop firm challenges). Each account’s data is private to you.

4 Subscriptions & Billing

Plans

Toastlytics offers a Free tier and paid subscription plans (Pro and Team). Pricing is displayed at toastlytics.com/#pricing and may change with notice.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period. You will not receive a prorated refund for unused time, except where required by applicable law.

Downgrade

If you downgrade from Pro to Free, your existing trade data remains accessible and readable. New features requiring a Pro subscription will be locked. Your data is never deleted solely because of a plan change.

Refunds

We offer refunds within 7 days of your initial subscription if you are unsatisfied. After 7 days, refunds are at our discretion. To request a refund, email hello@toastlytics.com.

5 Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Impersonate any person or entity, or falsely state your affiliation
• Upload malicious code, viruses, or any software intended to harm the Service or other users
• Attempt to gain unauthorised access to any part of the Service, other user accounts, or related systems
• Scrape, crawl, or use automated means to access the Service without our written permission
• Resell or sublicense the Service without entering into a written agreement with us
• Use the Service to provide services to third parties that compete with Toastlytics without our consent
• Engage in any activity that places an unreasonable load on our infrastructure

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6 Your Content

You retain full ownership of all trade data, notes, screenshots, and other content you create in Toastlytics (“Your Content”). We do not claim any ownership rights over Your Content.

By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

We will never:

• Sell Your Content to third parties
• Use Your Content for advertising
• Use Your Content to train AI models without your explicit consent
• Share Your Content with other users without your permission

7 AI Features Disclaimer

The AI Coach feature provides automated analysis of your trading history. You acknowledge that:

• AI-generated insights are based on your historical data and may contain errors or omissions
• AI responses are generated by a third-party AI model and may occasionally produce inaccurate or unexpected output
• The AI Coach is a pattern analysis tool, not a substitute for professional financial, legal, or trading advice
• We do not guarantee the accuracy, completeness, or usefulness of any AI-generated output

8 No Financial Advice

All trading involves risk. Past performance visible in your journal does not guarantee future results. You are solely responsible for your own trading decisions. We strongly recommend consulting a qualified financial adviser before making any investment decisions.

Toastlytics will not be liable for any trading losses, missed opportunities, or financial damages arising from your use of the Service or reliance on any information or AI output provided by it.

9 Intellectual Property

The Toastlytics name, logo, design system, and all software, features, and content we create are owned by us and protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its software without our prior written permission. You may not reverse-engineer or attempt to extract the source code of the Service.

10 Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

During the beta period, the Service may experience downtime, data loss, or breaking changes. We will make reasonable efforts to prevent these but cannot guarantee against them.

11 Limitation of Liability

To the maximum extent permitted by applicable law, Toastlytics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Trading losses or missed trading opportunities
• Business interruption
• Loss of goodwill

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD if you have not made any payments.

12 Termination

You may terminate your account at any time by deleting it from Settings. Upon deletion, all your data is permanently removed within 24 hours.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or create risk or legal exposure for Toastlytics. We will provide reasonable notice where possible.

Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, 11, and 14 survive termination.

13 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the “Last updated” date at the top of this page.

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you may terminate your account.

14 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms or use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of India.
